4. Putting aside the question of official courtesy I am of opinion that it was not within the strict duty of the American Consul to report the arrival of the "Wyoming" and her intention of drawing supplies from this Port to this Government, but I think that he ought in courtesy to have done so.

5. I am of opinion that it is so far from being advisable as that it is not competent to this Government to enforce the Proclamation against the American ship, and I am of opinion that it is not legally advisable to call on the American States Consul for any explanation on the subject.

I am directed by the Duke of Newcastle to transmit to you for the consideration of Earl Russell the copy of a despatch from the Officer Administering the Government of Hongkong reporting the arrival off the Port of Victoria of the Federal War Steamer "Wyoming", on the 26th of April last.

Mr Mercer wishes for instructions to guide his conduct in the event of the recurrence of a similar circumstance.
